Acknowledgement and Assumption of Risk

And

Release of Liability Agreement

In consideration of LONG BEACH PADDLE CO., LLC outdoor services and/or equipment to enable me to participate in water sports activities such as Kayaking and Paddle Boarding,

I _______________________agree to the following:

I hereby acknowledge and accept the following risks associated with participation in water sports activity with Long Beach Paddle Co., LLC

• There is a risk of changing water flow, tides, currents, wave action, and boat wakes.

• Collision with any of the following: other participants, other watercraft, man made or natural objects, (sand bars, oyster beds, rocks, etc.)

• Forces of nature; such as, exposure to sun, cold, wind, hail, lightning, and other phenomena.

• Activities that may take place in remote locations significantly delaying emergency medical care.

• Risk and dangers that may arise from foreseeable or unforeseeable causes including, but not limited to, guide decision making, including that a guide may misjudge weather, route location, tides, water conditions, objects which may be encountered in and the water, and which may or may not be obvious.

• My participation in such activities and/or use of equipment may result in injury or illness including but not limited to bodily injury, head injury, disease, strains, fractures, exposure to natural elements, sunburn, dehydration, heat exhaustion, heat stroke, insects that could cause serious injury or death. Accidental drowning could also be a of possibility.

• The presence of marine life such as, jelly fish, sting rays, sharks, oysters and other crustaceans.

ASSUMPTION OF RISK AND RESPONSIBILITY

I agree to assume responsibility for all risks of the activity, whether identified above or not. My participation in the activity is purely voluntary. I, assume full responsibility for myself and any minor children whom I am responsible for, any bodily injury, accident, illness, paralysis, death, loss of personal property and expenses thereof as a result of any accident which may occur while I / we participate in the activity.

RELEASE

I hereby release Long Beach Paddle Co., LLC and their owners, employees and agents from any and all claims, action, or losses for bodily injury, property damage, wrongful death, loss of services, or otherwise which may arise out of use of my use of their kayaks, paddle boards, equipment, or in participation in tours conducted by Long Beach Paddle Co., LLC

RESPONSIBILITY FOR EQUIPMENT

I, the Lessee assume full responsibility for all equipment, (Kayaks, Paddles, Back Rests, Paddle Boards, and PFD's) in lease from the time the equipment leaves the lessors property or location, until both lessee and lessor acknowledge the satisfactory return of the equipment. In the event the equipment is damaged, lost, or stolen, lessee assumes full responsibility and agrees to pay lessor (Long Beach Paddle CO., LLC) for fair REPLACEMENT VALUE of the equipment.
